RULES OF PARTICIPATION
in the Course

As used in these Rules, the following terms shall have the following meanings:

Terms and Conditions: a public offer (the "Offer") that is posted on the Company's website at https://fizikl.co/offer/.

The Company, the Service Provider, We, Us, or Our: FIZIKL IQ-FZCO, including any of its representatives, or employees, which provides access to the Course and remote informational support during the Course, including familiarization of the Client with the available nutrition programs, a mentor’s assistance and advice based on the Client’s individual requests, as well as any additional services subject to section 7 of the Terms and Conditions (the “Services”).

Client, You: a natural person who has applied for the provision of the Services and accepted the Offer in accordance with the Terms and Conditions.

Contract: the contract that has been concluded between the Company and the Client as a result of the acceptance of the Offer by the Client in accordance with the Terms and Conditions.

Platform: specialized virtual platform (software package) used for the provision of the Services in accordance with the Terms and Conditions and shaped as a mobile app.

Platform Administration: the Company’s staff members or third parties involved in the provision of the Services who assist the Clients.

Personal Mentor: a dedicated representative of the Platform Administration assigned to work directly with Participant, providing individual support in relation to the Services.

Course: a special program that is formed by the Course Content, provided to the Client through the Platform for the duration of the period prepaid by the Client, and administered by the Platform Administration. The Client has access to the Course and the Course Content for the duration of the prepaid period based on the acceptance of these Terms and Conditions.

Participant: a Client who has reached the age of 18 and has no medical contraindications to the participation in the Course. Pregnancy is also an absolute contraindication to the participation in the Course.

Personal Account: the Client's personal page on the Platform.

I. Acknowledgement
1.1. These Rules of Participation in the Course (the “Rules”) provide a general set of rules that should be followed by all Participants and include the rules of participation and interaction between the Participants and the Platform Administration or with other Participants (if applicable) during the Course, as well as establish responsibility for violation of these rules.
1.2. In everything else that is not directly regulated by these Rules, the parties are guided by the Terms and Conditions. In case of inconsistency between these Rules and the provisions of the Terms and Conditions, the provisions of the Terms and Conditions will prevail.

II. The Client’s obligations
2.1.In order to achieve the goals of participation, the Participant undertakes to independently and regularly monitor the information published by the Platform Administration on the Platform and in the Participant’s Personal Account. The Participant also undertakes to review or watch all relevant materials (articles, lectures, videos, etc.) and follow the recommendations provided by the Personal Mentor, who will specify which materials to study and where they can be found. The Participant confirms their familiarization with the information by clicking a "like" button under the respective material.
2.2. If the Participant knows that for any reason (personal/family circumstances, business trip, etc.) the Participant will not be able to monitor and study the information specified in paragraph 2.1 of these Rules for three (3) or more consecutive calendar days, the Participant is obliged to notify the Personal Mentor in advance in their Personal Account or WhatsApp.
2.3. In order to achieve the goals of participation, the Participant generates reports that should contain information about the Participant’s calorie intake per day, weight, physical activity, as well as other relevant information requested by the Personal Mentor. Such reports are to be generated by the Participant in their Personal Account on a daily basis.
2.4. In order to achieve the goals of participation, the Participant measures the physical parameters of their body in accordance with the recommendations provided by the Personal Mentor. After that, the Participant uploads the information to their Personal Account. Such information should be updated on a weekly basis and uploaded no later than the last day of the corresponding calendar week of the Course.
2.5. In order to achieve the goals of participation, the Participant takes and uploads to their Personal Account their full body photos (from the back, side, and front) in accordance with the recommendations provided by the Personal Mentor. Such photos are to be uploaded once a month, starting from the date of the beginning of the Course.
2.6. During the Course, from the moment the first individual “Target” has been provided to the Participant (as specified in paragraph 3.1.), it is strictly prohibited to consume any alcoholic beverages. This ban does not apply to the Participants who completed the Course at least once before (or by agreement with the Personal Mentor). However, the Personal Mentor reserves the right to restrict or prohibit such a Participant from drinking alcohol during the Course if it negatively affects the results of the Participant.
2.7. The Participant undertakes not to publish or otherwise distribute materials and information published by the Platform Administration on the Platform and in the Participant’s Personal Account or provided by the Platform Administration to the Participant in any other way, without prior written permission of the Platform Administration. In each case of such permitted publication, the Platform must be mentioned as the source of such information (materials).
2.8. Without obtaining any prior permission in accordance with paragraph 2.7. of these Rules, the Participant has the right to publicly retell in their own words, including in their personal social media accounts, the information received during the Course, as well as to share any of their results, interim or final. In each case, the Platform should be mentioned as the source of such information.

III. Individual goals and feedback
3.1. Along with the recommendations posted on the Platform that are common to all Participants, the Personal Mentor provides the Participant, on a weekly basis, with a set of individually calculated parameters to be met by the Participant (hereinafter referred to as the "Target"), including, but not limited to:
- recommendations regarding the rates of daily calorie and protein intake, etc.;
- recommendations regarding daily physical activity (the minimum number of steps, etc.);
- other recommendations at the discretion of the Personal Mentor.
3.2. The first Target is provided to the Participant at the beginning of the second week of the Course. Each subsequent Target is provided to the Participant after the Participant submits the weekly report and on its basis. After considering the Participant's weekly report, the Personal Mentor may conclude that the previous set of individually calculated parameters does not require adjustment—in this case, a new Target is not provided, and the Participant should be guided by this previous set of individually calculated parameters (the previous Target).
3.3. Monthly, within four (4) business days from the moment the Participant uploads their photos in accordance with paragraph 2.5 of these Rules, provided that the Participant has fulfilled the obligations under paragraphs 2.3 and 2.4, the Platform Administration (the Participant’s Personal Mentor) sends the Participant extended feedback containing information about the Participant’s progress and prospects of the achievement of the individual goals set for the Participant in the Course.

IV.Communication and Interaction rules
4.1. All personal questions (regarding the individual Target, etc.) are to be asked by the Participant in "Chat" section in the Personal Account.
4.2. The Platform Administration (including the Participant’s Personal Mentor) answers your questions every day (the Platform Administration reserves the right to appoint a new Personal Mentor if necessary). The average response time is within twenty-four (24) hours.
4.3. In case the Participant experiences any difficulties in interacting or communicating with their Personal Mentor or any other member of the Platform Administration, the Participant shall inform the Company about such difficulties at the Company’s email address specified in clause 10.4 of these Rules.
4.4. A chat room with the Personal Mentor starts working from the beginning of the Course.
4.5. Chat room rules of conduct:
- any advertising is prohibited;
- it is prohibited to create or advertise any third-party chat rooms;
- voice messages are prohibited;
- any inappropriate behavior (e.g., accusations, insults, aggression) is prohibited (the Platform Administration reserves the right to assess the Participant's behavior in the chat room at the discretion of the Platform Administration);
- it is prohibited to discuss the personality or job performance of any member of the Platform Administration, including the Personal Mentor, etc.;
- it is prohibited to share information or post images (photos) that do not comply with the current legislation or accepted norms of morality.
4.6. The Personal Mentor decides whether the information and images (photos) posted by the Participant comply with the chat room rules provided by paragraph 4.5. In case any information or image (photo) posted by the Participant does not comply with the chat room rules, the Personal Mentor may delete such information or images (photos) or the Service Provider may exercise the rights provided by section 8 of these Rules.

V. Trial Period
5.1. The first seven (7) days of the Course are considered to be a trial period. During the trial period, the Participant has the right to unilaterally and without giving reasons refuse further participation in the Course and receive a refund of the paid cost of the relevant services in full.
5.2. After the expiration of the period specified in paragraph 5.1, the Participant’s refusal to participate in the Course and the corresponding refund of funds are carried out in accordance with the provisions of the Terms and Conditions.

VI. Medical contraindications
6.1. The Company and the Platform Administration do not provide medical services, do not diagnose any diseases, do not prescribe treatment, and do not interpret or comment on the medical test results of the Participants.
6.2. By accepting the Terms and Conditions and concluding the Contract, the Participant confirms that they have no medical contraindications for the participation in the Course.
6.3. The Participant takes complete and sole responsibility for the state of their health. If the Participant has concerns about the presence of medical contraindications for the participation in the Course that arise before the conclusion of the Contract or during its validity period, or if the Participant starts to experience any negative symptoms during the Course, the Participant must immediately seek appropriate medical advice from their physician or healthcare provider and follow the recommendations of such physician or healthcare provider.
6.4. The Participant is obliged to immediately inform the Platform Administration about any deterioration in the Participant’s health and/or about the appearance of any negative symptoms during the Course.

VII. Sports Training
7.1. Sports training during the Course is recommended by the Personal Mentor but is not mandatory.
7.2. The Participant decides whether to follow the recommendations of the Platform Administration regarding sports training at their own discretion, taking into account their health and physical condition, endurance, strength, etc.

VIII. Liability Provisions
8.1. For violation of these Rules, the Participant is held liable in accordance with the Terms and Conditions and the provisions of these Rules.
8.2. In each case of violation of the provisions of paragraph 2.6 of these Rules, on the day following the day of such violation the Participant is obliged to perform the following action:
- take thirty thousand (30,000) steps in one day and provide the Personal Mentor with a screenshot from their chosen step counter mobile application which confirms the number of taken steps. If the Participant fails to fulfill the obligations provided for in this paragraph, the Contractor reserves the right to refuse to provide the services unilaterally without returning the paid price of the relevant services to the Participant.
8.3. In case of violation of the provisions of paragraph 4.5. of these Rules, the Contractor reserves the right (without any further explanation) to terminate the Participant's access to Personal Mentor support for the remainder of the Course or until the date of termination of the Contract. The Participant will retain access to the course content in accordance with the terms and сonditions of the Contract.

IX. Confidentiality of the Participant’s data
9.1. The Company and the Platform Administration shall take all necessary technical and organizational measures to ensure the protection of confidential information received from the Participant before or during the Course. Personal data, as well as other information posted by the Participant in the Personal Account, are available only to the Participant and the Platform Administration and are used by the Platform Administration only for the purposes stated in the applicable Privacy Policy.
9.2. The Participant acknowledges and agrees that any information shared through third-party services, such as WhatsApp, is outside the control of the Platform Administration. The Platform Administration shall only ensure the security of such information within the limits of the protections available to them. The Participant assumes full responsibility for the confidentiality and security of any information shared through third-party services, and the Platform Administration shall not be held liable for any unauthorized access, disclosure, or misuse of such information.

X. Other provisions
10.1. The Company offers the Participant access to the Course Content on the Platform for the duration of the prepaid period only. Upon expiration of the prepaid period, access to the Course Content is terminated.
10.2. These Rules form an integral part of the Terms and Conditions and the Contract.
10.3. The Company reserves the right to unilaterally amend these Rules from time to time. Any updates will come into force at the moment of publication of such updates on the Company’s website at https://fizikl.co/rules/ and, from the moment of publication, apply to all Participants.
